Terms of Use for Website

The Aichi Triennale Organizing Committee (the "Organizing Committee") provides https://aichitriennale.jp/ and its subdomains (the "Website"). Please read and review the below carefully before accessing or using the Website. By accessing and using the Website, it is deemed that you have read, understood and agreed to the Terms of Use. If you do not agree to the Terms of Use, you shall not access or use the Website. The Organizing Committee may change these Terms at any time without advance notice.

Article 1: Disclaimer

  1. The Organizing Committee will endeavor to ensure that any information it provides on the Website (text, photographs, illustrations, videos and sounds, etc.) is accurate; however, it does not warrant the accuracy, completeness or lawfulness, etc. of said information.
  2. Under no circumstances shall the Organizing Committee be liable for any damages incurred by the Users arising out of discontinuance, suspension, termination, unavailability, or modification by the Organizing Committee of the Website, cancellation or loss of messages or information transmitted by the Users to the Website, deletion of the registration of the Users, loss of registered data or failure of or damage to equipment through the use of the Website, or otherwise in connection with the Website.
  3. Websites that establish links to/from the Website and are operated by third parties other than the Organizing Committee (the “Link Sites”) are not under the control of the Organizing Committee. The Organizing Committee shall not be responsible for the content of Link Sites and shall not be liable for any loss or damage suffered by Users as a result of their using or not being able to use the Link Sites. YOUR USE OF THIRD PARTY WEB SITES AND RESOURCES IS AT YOUR OWN RISK.
  4. Users are requested to acknowledge in advance that the Organizing Committee may change the contents of the Website without advance notice to facilitate the accurate and correct use of the Website by the Users.

Article 2: Intellectual Property Rights

  1. Intellectual property rights within and to any information on the Website (text, images, illustrations, videos and sounds, etc.) (referring to copyrights, rights of patent, utility models, designs, trademarks and other intellectual property rights, and including rights to receive such intellectual property rights or to apply for the registration of the same) shall be vested entirely in the original copyright owners or persons to whom the copyright is licensed. Users shall not use such intellectual property rights, in whole or in part, exceeding the scope authorized by law, such as for private use without obtaining the consent of the original copyright owners.
  2. Users shall not convert or reprint any information or content that the Organizing Committee transmits by e-mail or the like without obtaining the consent of the Organizing Committee.

Article 3: Links

  1. Users may provide links to the Website without application, in principle; provided, however, that we may refuse any links from Websites that fall under any of the following items, even if links to third party websites have already been provided:
    1. Links that violate or are likely to violate laws, regulations or good public order or morals;
    2. Links that slander or defame the Organizing Committee, third parties or their business or services;
    3. Links that do not conform to the policy of the Organizing Committee, such as links whose purpose is sales or solicitation;
    4. Links that are likely to undermine the confidence of the Organizing Committee in society; or
    5. The Organizing Committee determines that Links are not appropriate for other reasons.
  2. Users are requested to set a URL link at the top of the page (https://aichitriennale.jp/en/). Further, banners shall not be altered without the permission of the Organizing Committee.

Article 4: Privacy

The Organizing Committee respects the privacy of Users. The Organizing Committee will handle the personal information of Users properly in compliance with its privacy policy.

Article 5: User environment

It is recommended that Users use the Website with the latest version of the following browsers. The Website may not function and may not display properly in the case of use in an environment other than that recommended or, even in the recommended environment, if it is dependent on the equipment, security software or browser setting of the User:

  2. Firefox
  3. Google Chrome; or
  4. Safari

Article 6: SSL

Pages of the Website handling personal information encrypt such information via SSL (Secure Socket Layer) transmission to protect the information of Users from unauthorized access by malicious third parties.

Article 7: JavaScript

Some pages of the Website use JavaScript. If Users disable the JavaScript function on his/her browser, the Website may not function and may not display properly. Prior to browsing, Users are requested to enable JavaScript on their browser setting.

Article 8: Cookies

The Websites use Cookies to provide better services. Cookies are small text files that are stored on your computer or mobile device. Information handled by the Cookie does not identify the Users and is used only for service improvement by the Organizing Committee. Cookies do not undermine the privacy or use environment of the Users.

Article 10: Supplemental Provisions

These Terms shall come into force as of September 8, 2020.

Article 11: Governing Law

The Terms shall be governed by and construed in accordance with the laws of Japan.

Article 12: Jurisdiction

Any and all disputes arising out of or in connection with the Terms shall be submitted to the exclusive jurisdiction of the Nagoya District Court, Japan, in the first instance.

Taking Photographs and Videos by Visitors at the international exhibition of Aichi Triennale

  1. Taking photographs and videos of the exhibition environment is authorized only for private use in principle, except with regard to certain works. The transmission of such photographs by the Internet including via Websites, blogs, social medias or e-mail is authorized only for non-commercial, on condition indicating the titles and credits.
  2. Please do not use a tripod or flash when taking photographs and videos.
  3. Please apply to the Organizing Committee regarding application for a photograph or video competition or to post an image or photograph.
  4. Alteration of original works and derivative works will be prohibited.
  5. If other visitors or staff are depicted in a picture or video, publication of the picture or the video may constitute an infringement of the image right. PLEASE BE CAREFUL ON THIS MATTER.
  6. Any other acts violating the Copyright laws and other laws are prohibited.

Terms of Use for Social Media

The Aichi Triennale Organizing Committee (the “Organizing Committee”) specifies the terms of use (the “Terms”) for operating an official account (the “Official Account”) on social media, as follows.

Article 1: Scope of application of Terms

  1. The Terms shall apply to all users who, in connection with the Official Account operated by the Organizing Committee and services incidental thereto (the “Services”), use the Services (referring to any act of using the Services by means of submission, posting, publication, display, provision, browsing, or direct message function)(the “Users”).
  2. Upon the use of the Services, Users shall comply with the terms of use specified by the respective social media operating companies and the Terms. In the case of any inconsistency between the terms of use specified by the respective social media operating companies and the Terms, the terms of use specified by the respective social media operating companies shall take precedence.

Article 2: Operation Content

  1. The Organizing Committee transmits a variety of information including information on “Aichi Triennale” or contemporary art from the Official Account listed in 2 below:

  3. The Official Account may be terminated or deleted without advance notice.
  4. The Organizing Committee shall not commit to replying when Users post comments on the Official Account (referring to comments, photographs, videos, links or other contents), or when a direct message is transmitted to the Official Account.

Article 3: Matters regarding compliance for use

  1. Users shall not engage in any act that falls under any of the following items in connection with the use of the Website (the “Prohibited Acts”):
    1. Acts of spoofing to third parties including the Organizing Committee;
    2. Acts that infringe or are likely to infringe the rights and interests of the Organizing Committee, other Users or third parties;
    3. Acts of slandering or defaming the Organizing Committee, third parties or their business or services, or of posting or transmitting information without ground;
    4. Acts that infringe or are likely to infringe the privacy of third parties without obtaining the consent of the third parties concerned, such as the identification, disclosure or divulgence of personal information;
    5. Election campaign activities or similar acts;
    6. Missionary or solicitation activities in connection with a specific religion, organization or association;
    7. Acts of profit making using the Services or similar acts (including the introduction or solicitation of Web sites);
    8. Acts of posting or transmitting malicious computer programs or disguised files;
    9. Acts of interfering with the use or access by other Users of the Services, in whole or in part;
    10. Acts of posting or transmitting information of harmful, obscene, violent or discriminative content or information that suggests or induces such content;
    11. Acts that lead to or are likely to lead to criminal acts;
    12. Acts that interfere with the operation of the Services or that damage the trust of the Organizing Committee;
    13. In addition to the acts in any of the foregoing items, acts that violate or are likely to violate laws, regulations or good public order or morals; or
    14. Other acts that the Organizing Committee judges inappropriate with regard to the Services;
  2. If Users post comments that fall under the Prohibited Acts as set forth in any item of the preceding paragraph, the Organizing Committee may block the account of said Users or delete said posting without advance notice; provided that such deletion shall be limited to posting that the Organizing Committee is able to delete when it uses the relevant social media.
  3. If the Organizing Committee judges that Users have violated the terms of use of an social media company in connection with the use of the Services, the Organizing Committee may notify the relevant social media company without advance notice and may request that the social media company take suitable measures including temporary or permanent suspension of the User’s use of the social media.
  4. If Users cause third parties to suffer loss or damage in connection with the use of the Services, he/she shall compensate such loss or damage suffered by or shall settle any disputes with said third parties on his/her own responsibility and expense, and he/she shall indemnify and hold harmless the Organizing Committee from and against claims raised by the third party for such loss or damage.

Article 4: Disclaimer

  1. The Organizing Committee shall not warrant the accuracy, completeness or lawfulness, etc. of information in connection with the contents of the Official Account, postings, comments, images or videos.
  2. The Organizing Committee shall not be liable for any use of the Services by Users.
  3. Under no circumstances shall the Organizing Committee be liable for any damages incurred by the Users arising out of discontinuance, suspension, termination, unavailability, or modification by the Organizing Committee of the Services, cancellation or loss of messages or information transmitted by the Users to the Services, deletion of the registration of the Users, loss of registered data or failure of or damage to equipment through the use of the Services, or otherwise in connection with the Services.
  4. The Organizing Committee shall not be liable for any trouble that occurs among Users or between Users and third parties in connection with the Services.
  5. In the case that there is a social media other than the Official Account that has the same name as the Official Account, the Organizing Committee shall not be liable in any event.
  6. The Organizing Committee shall not be liable for any spoof postings on the Official Account.
  7. The Organizing Committee shall not be authorized in any event to answer questions concerning websites or social media operated by the respective operating companies other than the Organizing Committee, or software or applications provided by third parties.

Article 5: Intellectual Property Rights and Privacy

  1. Intellectual property rights within and to the Services and posted data (text, images, illustrations, videos and sounds, etc.) (referring to copyrights, rights of patent, utility models, designs, trademarks and other intellectual property rights, and including rights to receive such intellectual property rights or to apply for the registration of the same) shall be vested entirely in the original copyright owners or the persons to whom the copyright is licensed, and the license to use the Services based on the Terms shall not mean the license to use the intellectual property rights within and to the Services and posted data.
  2. When they use the Services, Users shall represent and warrant to the Organizing Committee that they have valid rights, and that their use does not infringe the rights of third parties.
  3. If Users who own intellectual property rights to posted data post such data in connection with the use of the Services, it is deemed that the Users grants the Organizing Committee a non-exclusive license free of charge concerning the intellectual property rights in question, only in the scope necessary for the Organizing Committee to operate the Services at the time of the posting.
  4. The handling of personal information shall be governed by the “Privacy Policy,” which is separately specified.

Article 6: Change of Terms

  1. The Organizing Committee may change the Terms without obtaining the consent of the Users. In this case, the Terms after the change shall take effect when the Organizing Committee posts the same on the Aichi Triennale Official Web Site, unless the Organizing Committee specifies separately otherwise.
  2. Users who do not agree with the revised Terms concerning the Services are requested to discontinue their use of the Services.

Article 7: Supplemental Provisions

These Terms shall come into force as of June 30, 2023.

Article 8: Governing Law

The Terms shall be governed by and construed in accordance with the laws of Japan.

Article 9: Jurisdiction

Any and all disputes arising out of or in connection with the Terms shall be submitted to the exclusive jurisdiction of the Nagoya District Court, Japan, in the first instance.

Privacy Policy

The Aichi Triennale Organizing Committee (the “Organizing Committee”) is committed to the strictest control of the collection, use and management of personal information and to ensuring that any information gathered will be used in only the appropriate way.

Article 1: Personal information

Personal information means information relating to an individual that can identify a specific individual, such as addresses, names, telephone numbers and e-mail addresses. Information that can be collated with other information and can thereby identify a specific individual is included.

Article 2: Collection of personal information

When collecting personal information, the purpose of the work involving the handling of personal information shall be made clear in advance. The collection of personal information shall be performed within the scope necessary to achieve the purpose. When the Organizing Committee collects personal information by way of the website operated by the Organizing Committee (i.e. https://aichitriennale.jp/ and its subdomains), the voluntary provision of information (registration) by the users (“Users”) shall be the principle.

Article 3: Utilization and provision of personal information

The personal information provided (registered) by Users shall not be utilized or provided for any purpose other than the purpose of affairs involving the handling of personal information unless such utilization and provision are required by laws, regulations, or prefectural ordinances, consent is obtained from Users, or there are specific provisions in Article 69 of the Act on the Protection of Personal Information (Act No. 57 of 2003).

Article 4: Management of personal information

Appropriate measures to prevent divulgence, unauthorized use or alteration shall be taken for personal information collected from Users. Personal information that it is no longer necessary to retain shall be deleted surely and promptly. The Organizing Committee may outsource a part of its work to ensure the smooth performance of its work. In such case, a contract shall be executed with the outsourcee concerning the proper handling of personal information, and the outsourcee shall be supervised to ensure proper handling.

Article 5: Others

Matters that are not specified in this Privacy Policy shall be governed by the “Act on the Protection of Personal Information” and shall be handled properly.

Article 6: Supplemental Provisions

These Terms shall come into force as of April 1, 2023.

Article 7: Governing Law

The Privacy Policy shall be governed by and construed in accordance with the laws of Japan.

Article 8: Jurisdiction

Any and all disputes arising out of or in connection with the Privacy Policy shall be submitted to the exclusive jurisdiction of the Nagoya District Court, Japan, in the first instance.
